Chapter 1. General Provisions

Article 1 (Purpose)
The purpose of these Terms of Use is to define the basic terms and conditions regarding the registration and use of the online services provided by TEN PERCENT COFFEE (hereinafter referred to as "TEN PERCENT COFFEE").

Article 2 (Effectiveness and Amendment of Terms)
1. These Terms shall become effective when they are posted on the Service page or notified to Members through other appropriate methods.
2. TEN PERCENT COFFEE may revise these Terms when reasonable grounds exist. Any revised Terms shall be announced on the Website or notified to Members via e-mail and shall take effect upon such notification. If a User does not agree with the revised Terms, the User may cancel their registration or withdraw their membership. Continued use of the Service after the revision shall be deemed acceptance of the amended Terms.

Article 3 (Matters Not Specified in These Terms)
Matters not specified in these Terms shall be governed by applicable laws and regulations, including the Framework Act on Telecommunications, Telecommunications Business Act, regulations of the Korea Communications Standards Commission, Code of Ethics for Information and Communications, Software Protection Act, and other relevant laws.

Article 4 (Definitions)
The definitions of terms used in these Terms are as follows:
1. User: A person who receives services provided by the Website in accordance with these Terms.
2. Registration: The act of completing a service agreement by entering required information in the registration form provided by the Website and agreeing to these Terms.
3. Member: A person who has completed registration by providing personal information to the Website and is eligible to use the services provided by the Website.
4. Password: A combination of letters and numbers selected by the User to verify the identity of the Member ID and protect personal information during online communication.
5. Withdrawal: The act by which a Member voluntarily terminates the service agreement.

Chapter 2. Provision and Use of Services

Article 5 (Establishment of Service Agreement)
1. The service agreement is established when an applicant completes registration by entering the required information in the registration form provided by the Website.
2. TEN PERCENT COFFEE may cancel or refuse registration in the following cases:
  1) When an applicant uses another person's identity for registration.
  2) When false information is provided in the registration application.
  3) When an applicant interferes with another person's use of the Website Service or illegally uses another person's information.
  4) When the Website is used for activities prohibited by applicable laws or these Terms.
  5) When the registration requirements established by TEN PERCENT COFFEE are not satisfied.

Article 6 (Modification and Cancellation of Registration Information)
1. Members must promptly update any changes to the information provided during registration through the "Edit Personal Information" function.
2. Members who wish to cancel their registration must apply for withdrawal through the "Withdraw Membership" function.
Article 7 (Consent to Use of Member Information)
1. Members' personal information shall be protected in accordance with applicable laws regarding personal information protection.
2. Member information collected by the TEN PERCENT COFFEE Website shall be used, managed, and protected as follows:
  1) Use of Personal Information: TEN PERCENT COFFEE shall not disclose or distribute Members' personal information collected in relation to the provision of services to any third party without the Member's consent. However, this shall not apply in cases where disclosure is required by a government authority pursuant to applicable laws, where information is required for installation verification and after-sales management by entrusted service providers, where requested by local government authorities for subsidy payments, where required for criminal investigations or by relevant information and communications authorities, where requested according to procedures prescribed by applicable laws, or where the Member has voluntarily disclosed their personal information provided to the TEN PERCENT COFFEE Website.
  2) Management of Personal Information: Members may update their personal information at any time through the personal information management section of the Service to protect and manage their information.
  3) Protection of Personal Information: Members' personal information may only be accessed, modified, or deleted by the Member or the Website administrator upon the Member's request. Such information is managed exclusively through the Member ID and password. Therefore, Members must not disclose their ID or password to others and must log out after completing use of the Service.

Article 8 (Security of User Information)
1. From the moment an applicant completes the registration process for the Website Service, the Member is responsible for maintaining the confidentiality of the information entered. The Member shall be responsible for all consequences arising from the use of their ID and password.
2. Members are responsible for managing their ID and password. If a Member discovers that their ID or password has been used improperly, they must immediately notify TEN PERCENT COFFEE. TEN PERCENT COFFEE shall not be responsible for any consequences resulting from failure to provide such notification.
3. Users must properly terminate their connection whenever they finish using the Service. TEN PERCENT COFFEE shall not be responsible for any damages or losses caused by a third party accessing or using the User's information due to improper termination of the connection.

Article 9 (Suspension and Restriction of Service)
1. TEN PERCENT COFFEE may suspend or restrict the use of the Service if a User violates these Terms or falls under any of the following circumstances:
  1) When service facilities require unavoidable maintenance or construction work.
  2) When a telecommunications service provider suspends telecommunications services in accordance with applicable laws.
  3) When service use is disrupted due to national emergencies, service facility failures, excessive traffic, or other unavoidable circumstances.

Chapter 3. Obligations and Responsibilities

Article 10 (Obligations of TEN PERCENT COFFEE)
TEN PERCENT COFFEE shall not disclose or distribute Members' personal information to any third party without the Member's consent. However, exceptions shall apply when disclosure is required by government authorities pursuant to applicable laws, when information is required for installation verification and after-sales management by entrusted service providers, when requested by local government authorities for subsidy payments, when required for criminal investigations or by relevant information and communications authorities, when requested according to procedures prescribed by applicable laws, or when the Member has voluntarily disclosed their personal information provided to the TEN PERCENT COFFEE Website.

Article 11 (Obligations of Members)
1. Members must provide accurate information when registering. Members must also maintain and update their information to ensure that the information provided remains accurate. Members shall not allow third parties to use their ID or password.
2. Members may not engage in any commercial activities using the Service without prior approval from TEN PERCENT COFFEE.

Article 12 (Prohibition of Transfer)
Members may not transfer or assign their rights to use the Service or any other status under the service agreement to another person.

Article 13 (Compensation for Damages)
TEN PERCENT COFFEE shall not be liable for damages incurred by Members in connection with the use of the Service when such damages are caused by the Member's intentional actions or negligence.

Article 14 (Disclaimer)
1. TEN PERCENT COFFEE shall be exempt from responsibility for providing the Service when the Service cannot be provided due to natural disasters or other force majeure events.
2. TEN PERCENT COFFEE shall not be responsible for service interruptions caused by reasons attributable to Members.
3. TEN PERCENT COFFEE does not approve, oppose, or modify opinions expressed by Members or third parties. TEN PERCENT COFFEE shall not be liable under any circumstances for any benefits obtained or damages incurred by Members based on information contained in the Service.

Article 15 (Jurisdiction)
Any disputes arising in relation to the use of the Service shall be subject to the jurisdiction of the court having jurisdiction over the location of TEN PERCENT COFFEE's headquarters.

Supplementary Provision
These Terms of Use shall take effect from November 10, 2021.
